A jury awarded a Eugene man after he was kicked by an Oregon State Police captain during a 2012 traffic stop. The Register-Guard reported that Capt. Rob Edwards testified in U.S. District Court in Eugene as part of a civil trial that his force was in line with state police policies. Edwards was accused of using excessive force against Justin Wilkens, whose collarbone was broken when Edwards took him into custody Aug. 3, 2012, after chasing down the speeding rider. The jury claimed Edwards violated Wilkens' civil rights. Wilkens says he did not recognize Edwards' unmarked car as a police vehicle. Wilkens sued Edwards for alleged civil rights violations and sought unspecified noneconomic damages in addition to more than in reimbursement for medical and motorcycle towing and repair bills. motorcyclist put a lot of drivers in danger. All cars had no trouble pulling to the side. I can't buy that the biker didn't know it was a cop tailing him. As far as the cop knows this could have been a dangerous person. Hope the biker at least got a couple of tickets or suspension for this.

The cop didn't do anything wrong. The douche bag on the motorcycle tried to pick up his bike and run again. Kudos to the cop. I would've swung a bat across evil Kinevil's fat head.

This is so wrong, the cop hits the bike. He could have severely injured or killed the bike driver, then he attacks him. Seems to me someone is on a power trip. The biker looked like he was going to pull over too.

There's never a good reason for a police officer to kick anyone.
It is impractical and unreliable for defending or disarming. In this case the officer clearly did not know how to deal with the situation as he was pumped up with adrenalin from the chase. Bumping into the bike would have been understandable if the suspect was trying to escape, but again this was aswell, clearly clouded by the adrenalin. -
The wrong part comes when the biker is doing what the cop said and the cop still throws the kick while holding a gun. Great work cop! mom and dad should be proud of you...dick

I would have fought back. 1. He didn't use lights he rammed him 2. It seems all he said was get down, not why he is detaining him or that he is even detaining him. 3. Excessive force

I'm a rider and I can say for a fact that its easy to not realize who is behind you because you have to be focused on what is in front you. I'm not at all saying the biker was in the right as a matter of fact the things that he was doing is are what gives bikers a bad name, but the cop was just as bad or worse. Police officers like him are why people hate cops and then he gets promoted to captain this is why people don't trust Law enforcement. At the very least he should have been demoted and fined. It really makes me wonder why police even have to guess as to why so many people have little to no respect for them. the rider got a settlement but not one penny of that will come out of that officers pockets. so how does winning a settlement teach that asswipe and other so called cops like him anything. He should have to pay at least 10g of that settlement. If he wont be fined, jailed, fired, demoted or have to pay part of the settlement then all he and others like will learn is that its ok to act outside the law. But the blame doesn't just stop there, when things like this happen and the city government doesn't step in to make sure that the appropriate disciplines aren't handed down then they need to be removed from their office as well.

As far as I know unmarked units cant perform traffic stops. I dont know if it applies in Oregon.

A little background sound or news article might help understand it. Depending on the accident the kick could have paralyzed him.The rider should have stayed down, less danger plus he can scream about pain so that everyone hears.
