While I applaud this video, The morass of legislation is offensive. If the bicycle is equipped with pedals it is a bicycle.
32km/h is too low a top speed limit as most road bicycles will go faster than this under human power on level ground. Speeds in excess of 70km\h can be achieved under favorable conditions. A more reasonable test would be due diligence, insofar as the operation and the speed being traveled.
As far as the classification as to whether it is indeed a motorcycle equipped with pedals, weight would be a much better indicator than potential wattage of the motor. The current legislation is woefully inadequate and ill conceived.
Electric bicycles and human powered ones should be subject to speed limits just the same as road vehicles of other kinds. Mobility scooters are not equipped with pedals so they do not apply. Also 3 and 4 wheel vehicles equipped with pedals need a separate use definition as they pose different issues due to the increased width. Even a 2 wheeled ebike with an ultimate top speed of 80 km/h is still an ebike and should not be registered as a motor vehicle assuming the weight of the vehicle is reasonable for example less than 40 to 50 kg without rider.
Dangerous use of a human powered bicycle is still dangerous, and the ultimate mass of the vehicle combined with the velocity is the real danger to pedestrians and other cyclists, the rest of this legislation is simply a cash grab and an excuse to drag a person into the justice system, where we all know there is no justice. -

I have an argument between me and my friend hes studying to be an officer and I think he has alot of miss information. my question is, is an ebike considered a bicycle even when its stopped by an officer or is it treated as a car or other vehicle. what I mean exactly is in canada an officer stops a car and asks for id and you have to present it, but if an officer stops my bike and asks for id I can refuse to give it to him under common law and the charter of rights and freedoms. so is an ebike a car or bicycle in relation to police stops.

"Motor-assisted" bicycles have a speed limit of 50 km/hr. It is the "power-assisted" bicycles that have the 32 km/hr limit.
The practical difference? Power-assist bicycles are just regular bikes with electric hub motors. They are allowed on municipal bike trails, while the motor-assisted bikes like the one in this video are not.
The legal difference is not really explained. The HTA makes a distinction, though vague, between motor-assist and power-assist. HTA section 228 1 (1) Although, having a little electric hub motor does not change the helmet law. Over 16, and the rider is not required to have. Only on the motor-assisted bike which is treated like a scooter. -

I think if it looks like a moped it should be counted as a road vehicle, a bicycle should look like a bicycle, those pedals don't look as they function very well - it would be very hard to peddle for any distance. I ride a completely illegal ebike with a 1500 watt hub motor (to many watts plus goes to fast) that does look illegal ( but it still looks like a bike), I ride daily past the biggest cop station in Victoria ( I live directly opposite) and have had a dozen cops looking at my ebike at the local subway while buying a sandwich. They just don't care as they are after people who commit real crimes.

An average fit road biker can go 40km/h on flat ground. What if i get pulled over and a cop thinks my e-bike doesn't classify as an e-bike? Can I show them somehow so I don't get my bike taken away?

this has got to be the most assine law. I can pedal my normal bike much faster than 32km/h and will never get pulled over for doing so as long as I am not breaking the speed limit. This is just another cash grab. Ontario is over regulated and always has been. Anytime someone comes up with a good idea, the law has to get involved to get their greedy hands on hard working peoples money. Phucking Law

Reeeally good video, I work in an ebike shop and we get all these questions every single day!! So many people who lost license because of drinking and driving, so many people asking about the power and speed limits... -
My uncle is a Sheriff in Toronto and according to him, if you are riding a vehicle/vespa/scooter that does NOT require legal licensing and registration through the Ontario Ministry Of Transportation being caught riding one while impaired does not have the same results as driving an actual MOTOR VEHICLE like a Honda Accord or a Dodge Caravan while impaired. People need to know your rights. If you are riding/driving something that does not have legal registration requirements and somebody takes that property from you, then they can be charged because that's theft. And according to the Ontario Criminal Act, removing or taking possession of one's personal belongings without that person's consent or approval is considered a criminal offence in the province of Ontario!

So many of the rules that apply to these ebikes also apply with bicycle riders. Ebikes can ride anywhere a bicycle can etc. But if your caught riding an ebike while impaired, your treated like a licensed driver whose driving an SUV. This is where it gets all contradicted and fucked up. Until you've had a couple of drinks, it's like your riding a bicycle, but when your impaired, suddenly there's charges involved and this guy was talking about vehicles going to the pound. How can an ebike/scooter that's not registered or licensed with the Ministry Of Transportation of Ontario be confiscated under ANY circumstances if you don't even need a license to ride them!?? That would be called THEFT. And there are also laws about theft. And what's this about a previous history of impaired driving. This guy said, "if your driver's license has been suspended or revoked, then you are not legally allowed to drive a ebike/scooter." Why not?? If you don't need a license/registration or insurance to ride a vespa scooter, then why does your driver's license suddenly become a significant topic?? Your driver's license means nothing if you're operating a scooter that doesn't require one by law. The word here is LOOPHOLES. Let's get the story straight here people.
